According to researchers, nearly 99 percent of doctors in medical fields that are considered high-risk will be involved  in a medical malpractice lawsuit. Even in fields that are less risky, nearly 75 percent of doctors are sued.

Doctor apologies may be unusable in court

A new bill in legislation at this time states that doctor apologies may not be able to be used in court.

While doctors and hospitals are required to report medical mistakes to the state, doctors do not offer any apologies for fear that it may hurt them later if the case ends up as a medical malpractice lawsuit.

A short section of a new bill is trying to change this. If the language is made a law, it will make any statements of regret or apology unusable in court for any claim or civil action.

The goal of the bill is to create some sort of open communication that will allow patients to understand what went wrong and what will be done to prevent future errors. Officials are hoping that this will help to cut down on medical malpractice lawsuits.

Eighteen cases pushed to 2011 by Michigan Supreme Court

The Michigan Supreme Court has pushed back 18 cases back until January when the new justice comes aboard and conservatives are in the majority again.

The cases consist of appeals, personal injury cases and medical malpractice claims. All of these cases were supposed to be heard in December, but they would not be resolved until the current justice leaves office on Jan. 1, so these cases were pushed so that they could be heard under the new judge.

Woman underwent surgery for cancer, then told she was misdiagnosed

In 2006, a woman was told by a pathologist at a small hospital in Michigan that she had early signs of breast cancer that was found in a biopsy.

After this was found, the woman underwent surgery and she had a golf-ball size chunk removed from her breast. Now, her new doctor is telling her that her pathologist made a mistake and that the woman never had the disease.

This means that the surgery, radiation and fear of having cancer were all for no reason. The woman believed that the biopsy was 100 percent correct and never doubted it.

After an examination of breast cancer, it has been shown that determining whether a cluster of cells is malignant or benign can be very difficult. The federal government is now researching breast pathologies based on a report that stated that 17 percent of needle biopsies may be misdiagnosed.
