Florida jury awards $178 million in medical malpractice suit

Recently, a jury in Florida awarded a gastric bypass patient and his family $178 million in a medical malpractice lawsuit filed against Jacksonville’s Memorial Hospital and the surgeon who performed the weight-loss procedure. The plaintiff was awarded $168 million in compensatory damages and an additional $10 million in punitive damages.

The patient went to the hospital for gastric bypass surgery in March 2007, but suffered complications afterward. Court documents stated that these complications were not diagnosed or treated in a timely manner. As a result, the plaintiff suffered brain damage and lost his hearing and vision. He is now confined to a wheel chair and needs constant care.

According to the jury’s ruling, the hospital acted negligently and fraudulently by misrepresenting doctors and allowing them to perform procedures that they were not qualified to perform. The surgeon was also found to have acted negligently by failing to provide proper follow-up treatment.
